Advocates Call on Supreme Court to Reject Trump’s Call for ‘Absolute Immunity’ on Election Subversion Charges

Las Vegas, NVThe Supreme Court heard arguments Thursday in a case that will decide whether former President Donald Trump can claim sweeping, extraordinary and unprecedented criminal immunity for his attempts to undermine the results of the 2020 election.

Those oral arguments showed a court – stacked with Trump appointees – that appears eager to open the door to some level of presidential immunity. But even if the election subversion case is allowed to continue as it should, those conservative justices are still poised to kick the case back to the lower courts, all but ensuring that Trump’s most serious criminal trial will not begin before the November election.

Shelbie Swartz, Battle Born Progress Executive Director, issued the following statement: 

“Nobody is above the law, especially not former President Trump. But if the court’s conservative justices fold under the Trump camp’s obvious delay tactics and ensure a trial can’t begin before the election, then they have betrayed the American people. They have abdicated their responsibility and given cover to a man who incited a riot at the U.S. Capitol and tried to trample our democracy. Voters should be able to make a clear decision in November, armed with the knowledge that justice has been done.” 

Laura Martin, Progressive Leadership Alliance of Nevada Action Fund Executive Director, said the following:

“A man who suggested intravenous bleach therapy could cure COVID should not be trusted with a second presidential term, let alone unlimited executive power and immunity. There is no doubt courts matter, but for decades judicial conservatives have fought to stack the court with ideologues and grifters. So now, regardless of the laws our communities or Democratic presidents pass, conservatives can court-shop and overturn freedoms and protections Nevadans and people across the country need. These jurists now hold the power to decide if the twice impeached president facing 91 indictments can have unlimited power and immunity to do whatever he wants, even including violent acts against his opponents. There should be no lingering doubts about how critical this election is to the future of our democracy.”

“The Supreme Court’s consideration of whether former President Donald Trump can evade accountability for his horrific attempts to undermine our democratic process is deeply troubling. The fact that this discussion is even taking place underscores the urgent need to reaffirm the principle that no one, not even a former president, is above the law.
