Battle Born Progress Responds to Supreme Court Decision Leaving Texas Abortion Ban in Place  

LAS VEGAS, NV – This morning, the Supreme Court of the United States issued a decision on two legal challenges to the Texas law, S.B. 8, which bans abortion after 6 weeks – before many people even know they are pregnant. The Court ultimately held that S.B. 8 may stay in effect, referring the Department of Justice’s challenge back to the Fifth Circuit Court of Appeals, while also allowing some abortion providers to continue their lawsuit against the state. 

Annette Magnus, Executive Director of Battle Born Progress, said, “While we are relieved that abortion providers still have a path forward to sue state of Texas over S. B. 8, today’s decision is a foreboding prologue to an eventual overturn of Roe v. Wade. The decision today continues to uphold the uncertainty of abortion rights in Texas, and the country, by leaving in place this absurd and dangerous law that blatantly violates a Constitutional right. As Justice Sotomayor wrote today, the Supreme Court has, ‘betray[ed] not only the citizens of Texas, but also our constitutional system of government…. The Court should have put an end to this madness months ago, before S. B. 8 first went into effect. It failed to do so then, and it fails again today.’”

“It has been over 100 days since S.B. 8 became law, and already there are heartbreaking stories of those forced to remain pregnant against their will, or face exorbitant travel costs to seek abortion elsewhere. Let me be clear once again: Pregnant people have the right to make their own health care decisions without interference from politicians or judges. We will continue to fight to protect abortion access, especially now that Nevada is a safe haven for people seeking those health care services. We also need the Senate to immediately pass the Women’s Health Protection immediately, to protect abortion access for all pregnant people nationwide.”
